Terms and conditions of sale

Hereinafter referred to as the "Seller" or the "Company".

It has been set forth and agreed as follows:
1 - PREAMBLE
The description of the products offered for sale on www.ripaton.fr is accurate.
2 - THE PRICE
The current prices of the various products marketed by RIPATON are indicated in euros and include the current VAT.
Product prices do not include shipping costs, which are added to the amount of the order if the delivery option is selected. Otherwise, the price to be paid is only the amount of the order if the customer collects it from RIPATON's premises.
All orders will only be taken into account once payment has been received in full at the time the order is placed.
3 - PAYMENT
All orders placed on www.ripaton.fr can be paid for, according to the customer's choice, using the following methods of payment:
Credit card: by entering the card number, expiry date and security code on the back of the card in the appropriate field. The amount is debited in full on the day the order is placed.
Paypal: by logging on to your Paypal account, via the www.ripaton.fr website, and following the procedures set up by the interface, as part of a secure payment using your bank card.
Bank transfer: bank details will be sent to you by e-mail in the order confirmation. The order will only be validated on receipt of the transfer to our bank account.
4 - PAYMENT IN INSTALMENTS
This payment service is exclusively reserved for private individuals, on our site, whose billing address is located in metropolitan France, for all purchases between €100 and €2000 exclusively with Visa/MasterCard/American Express accepted payment cards.
This service is offered after validation of your basket by simple payment by credit card without charge, without justification or special formalities, or acceptance delay.
Payment will only be accepted under the following cumulative conditions (on the day of your order):
Your account must be credited with the amount of the first instalment;
The expiry date of your card must be greater than the date of your last monthly payment, i.e. 61 days after the order date.
Confirm your identity by entering the confirmation code sent by your bank to the telephone number you have given them.
5- DELIVERY
When placing an order, customers are free to choose the mode of delivery, either by choosing to have their order delivered to the destination of their choice, or by collecting their order directly from the Ripaton workshop.
Several delivery methods are available: home delivery, point relais, office delivery (workplace).
Bulky products are delivered on pallets. Pallet delivery is made to the foot of the building / garden level at the delivery address. Delivery is made by appointment for private customers and without appointment for business customers, Monday to Friday.
If the parcel received is visually damaged, the customer must make reservations on the delivery note that the carrier asks you to sign, giving precise details of the condition of the product(s) received (impacts, scratches, bent product, etc.).
In the event of error or damage, the customer must refuse the product and send us his/her reservations within two (2) days by e-mail to bonjour@ripaton.fr.
If a damaged parcel is accepted without reservations, it cannot be the subject of a subsequent claim.
6 - SHIPPING COSTS
Delivery charges are payable by the customer, who is informed of the amount of these charges before the final validation of the order.
It is the recipient's responsibility to check shipments on arrival and to make any reservations or claims that appear justified, or even to refuse the package if it is likely to have been opened or if it bears obvious signs of deterioration.
Postage is free for orders of €299 or more, including VAT and excluding postage (for mainland France and Belgium).
Delivery includes delivery to the address indicated, door-to-door for parcels.
For pallets, the customer must be equipped to unload the goods in the case of bulky orders (+1500€HT). If this is not the case, this must be specifically indicated at the time of order, in order to plan with the carrier, otherwise handling charges may be invoiced by the carrier.
At the time of delivery, the customer must unpack the product in the presence of the deliveryman/driver and check that the product delivered corresponds to the order and that no damage has occurred to the product before signing the delivery note. In the event of any anomaly, the customer must indicate the precise nature of his/her reservations on the delivery note. These reservations must be handwritten, dated, detailed and signed on the delivery slip. The words "damaged product", for example, are not sufficiently explicit.
The customer must indicate the nature of the damage: scratches, dents, stains, missing product, etc., as well as the condition of the parcel or pallet (torn or open parcel, broken or dented pallet).
In the event of error or damage, the customer must refuse the product and send us his/her reservations within two (2) days by e-mail to bonjour@ripaton.fr.
If the parcel has not been refused, any claim for damaged, missing or defective products must be made within two (2) days by e-mail to bonjour@ripaton.fr.
Any claim made after this deadline will not be accepted.
If the customer does not express any reservations to the carrier, the product delivered is deemed to be satisfactory and may not be contested at a later date.
7 - DELIVERY ZONE
Possible delivery countries are all European Union countries and some other countries. Please contact us for further information.
Delivery to Corsica: charges may apply if the delivery address is incorrect. The price is indicated on the website and varies according to the weight of the parcel.
8 - ADDRESS ERROR
The customer is responsible for the information entered on the recipient's address. The details entered must be clear, precise and complete. In this case, Ripaton cannot be held responsible for delays or returns due to address errors.
9 - RETURNING PARCELS
The return of a parcel unclaimed by the recipient is at the customer's expense as part of a second shipment.
In the case of an unclaimed parcel in a relay point (kept for 9 working days by the relay), and returned to Ripaton, the return costs will be invoiced to the customer in the case of a new shipment, or deducted in the case of a refund.
10 - DELIVERY TIME
The maximum delivery time is 30 working days (Hamon Law) and depends on the accessibility of the destination country. The times indicated are determined by "working days" from MONDAY to FRIDAY, excluding public holidays.
11 - LEAD TIME
Product lead times vary according to orders. For certain products, such as colored bases or custom-made products, a longer lead time may apply. This may also be the case if a product is out of stock.
12 - LIABILITY
RIPATON may not be held liable for any damage of any kind, whether material, immaterial or physical, which may result from the malfunction or misuse of the products marketed. The same applies to any modification of products by suppliers.
RIPATON shall not be held liable for the obligations contained in these General Terms and Conditions of Sale in the event that the non-performance of its obligations is attributable to the act of a third party, even if foreseeable, to the fault of the Customer, or the occurrence of an event of force majeure as defined by the French courts, or any other event that was not reasonably under the exclusive control of RIPATON. The information accessible on the Site is provided "AS IS" without warranty of any kind, implied or express, including but not limited to warranties as to the integrity, accuracy, timeliness, non-infringement, availability, reliability or completeness of the information, products,
RIPATON shall not be liable to any customer or third party for any indirect damage, loss of business, profits or sales, arising in any way whatsoever, even if such damage, loss or damage was foreseeable by RIPATON, or if its possibility had been brought to its attention.
RIPATON cannot be held responsible if custom-made products are not suitable for the customer's final project. RIPATON is not responsible for all the parts that make up the project.
If any modification is made to the product by the customer (such as drilling, painting, grinding, welding), Ripaton cannot be held responsible, and any request for return or refund will be refused.
Tolerance clause: RIPATON allows itself a margin of plus or minus 2 mm to 5 mm, depending on the model, on the measurements of its finished products, and therefore declines all responsibility for the extent of this margin. Consequently, the purchaser cannot take legal action or demand a refund or exchange.
The rendering of ACIER BRUT or VERNIS MAT colors may vary according to the color of the base steel, which may be darker or lighter depending on the batch. Consequently, photos are not contractual.
The customer must check the condition of the package/pallet received on delivery. If the package received is visually damaged, the customer must make reservations on the delivery note that the carrier will ask you to sign, detailing the condition of the product(s) received (impacts, scratches, bent product, etc.)
If a damaged parcel is accepted without reservations, it cannot be the subject of a subsequent claim.
No claims will be accepted for damaged products that have already been used or installed.
Any damaged goods received must be reported to RIPATON within 2 days of delivery (48 hours). After this time, no claim will be accepted.
13 - RIGHT OF WITHDRAWAL
Under the terms of article L.121-21 of the French Consumer Code, the customer has a 30-day cooling-off period to exercise this right, without having to justify his decision or pay any penalties. Return shipping costs are at the customer's expense.

The customer must inform www.ripaton.fr to accept the return.
Please contact customer service to receive a postage label. Under no circumstances should you frank the parcel yourself.
The customer will be reimbursed by cheque or bank transfer or by the means of payment used for the purchase within 14 days of receipt of the goods by www.ripaton.fr, following the exercise of the right of withdrawal. Delivery and return costs will be deducted from the refund.
The product must be unused, free of any marks, scratches or damage and must be returned in its original packaging. Restoration costs may be charged.
Any defects or damage to the products received must be reported when the products are unpacked from their packaging, and before they are assembled and used. All claims for damaged products must be made within 48 hours of receipt of goods, by e-mail to bonjour@ripaton.fr.
For all orders for personalized products, or products in the "CUSTOMIZED" range, the customer may not request the cancellation or modification of the order.
For all product orders requiring the creation of a personalized technical data sheet, the modification or cancellation of the dimensions initially entered will be invoiced at €100 inc. tax.
For any order of more than 20 products of the same model, or of more than €1500 including VAT, once the manufacture of the product has begun, the customer cannot request the cancellation or modification of his order.
Returns are only possible for standard products ordered on the site, and do not apply to made-to-measure products.
Customized products are neither exchangeable nor refundable, in accordance with article L121-20-1 of the French Consumer Code concerning the supply of personalized goods.
14 - FORCE MAJEURE
Neither Party shall be liable to the other for any failure to perform or delay in performance of any obligation under this Agreement caused by the other Party as a result of an event of force majeure within the time limit as defined in Article 1148 of the French Civil Code.
Expressly, the blocking of telecommunications, including telecommunications networks, lock-outs, riots, civil unrest, insurrection, civil or foreign war, nuclear risk, embargo, confiscation, capture or destruction by any public authority, bad weather, epidemic, blocking of means of transport or supply for any reason whatsoever, earthquake, fire, storm, flood, water damage, governmental or legal restrictions, legal or regulatory changes in forms of commercialization, any consequence of technological developments, unforeseeable by RIPATON, calling into question the norms and standards of its profession and any other unforeseeable, irresistible event beyond the control of the Parties preventing the normal performance of their mutual obligations.
15 - APPLICABLE LAW AND JURISDICTION
15.1 - Applicable law
These General Terms and Conditions of Sale and Use of Services are governed by French law. If the Customer's domicile and/or nationality is not French, the Customer accepts that the contractual relationship between the Customer and RIPATON is not governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.
15.2 - Data protection
LANGUAGE
The official language of these General Terms and Conditions is French. The use of any other language is indicative only. In the event of any difficulty of interpretation, the Parties shall refer solely to the French text.
JURISDICTION
Any dispute relating to the validity, interpretation, performance or non-performance of these General Terms and Conditions of Sale and Use of Services governing relations between the Parties shall be submitted to the competent courts under the conditions of ordinary law.
The information collected by RIPATON during a customer order is necessary to manage the transaction and to this end may be communicated in whole or in part to RIPATON's service providers involved in the execution of the order. The customer is informed that the same personal data may also be collected by an organization in charge of analyzing orders and combating credit card fraud. In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, customers have the right to access, rectify, object to and delete data concerning them.
